Abstract
Résumé Les différentes réformes législatives dans le domaine de la procédure pénale combinées à l'évolution du statut du juge des libertés et de la détention ont profondément changé la nature des fonctions de ce magistrat. Ce dernier devient, peu à peu, le juge du contrôle de la régularité de l'enquête dans la phase préparatoire du procès pénal. Deux éléments ont été déterminants dans l'évolution de son rôle dans le contrôle de la régularité d'actes d'enquête : l'exigence de motivation de ses décisions et la prohibition des motivations dites "serviles". 1 Aujourd'hui la motivation des décisions par ce magistrat est devenue une exigence législative notamment dans le domaine des autorisations concernant les techniques d'enquête spéciale mises en œuvre en matière de criminalité organisée. Ce magistrat assure désormais - sous le prisme de la liberté individuelle - le contrôle de la régularité des actes d'enquête, portant non seulement sur la légalité de la mesure, que sur l'appréciation des nécessités de l'enquête ou du respect du principe de proportionnalité.
