Les produits cosmetiques sont des produits du quotidien et sont donc au cœur des preoccupations des consommateurs. Les allegations cosmetiques jouent un role primordial dans leur choix d’achat et sont un levier strategique pour les firmes cosmetiques, il est essentiel que celles-ci soient encadrees de maniere efficace. Apres l’entree en vigueur du Reglement Cosmetique Europeen en Juillet 2013 (Reglement (CE) n°1223/2009), la Commission Europeenne a donc accorde beaucoup d’importance a l’application de la reglementation des allegations cosmetiques. Dans son rapport du 19 septembre 2016, La Commission Europeenne fait etat de la conformite des allegations aux six criteres communs enonces dans le Reglement (UE) n°655/2013. Pour etablir ce rapport, vingt et un des Etats Membres ont participe a la surveillance de leur marche et ont releve dix pour cent de non conformites parmi les allegations cosmetiques controlees. A partir du premier Juillet 2019, la huitieme version de la Recommandation de l’ARPP sur les Produits Cosmetiques entrera en vigueur et permettra d’assurer la prise en compte de la liste des six criteres communs. Tous les produits cosmetiques qui seront mis sur le marche apres cette date seront tenus de s’y conformer. Cette these reprend les fondements du Reglement Cosmetique Europeen et propose une analyse detaillee de la reglementation des allegations cosmetiques en Europe avec un comparatif de la reglementation des allegations cosmetiques dans d’autres entites reglementaires (Etats-Unis, Canada, Japon).
