Abstract
Des deux principes qui sont appliqués en matière de droit de la langue, celui de personnalité (concerne la personne indépendamment du lieu où elle se trouve) et celui de territorialité (en vigueur dans certaines aires définies), le premier, difficile à mettre en œuvre, est peu appliqué (Canada surtout) au profit du second. En France, hormis le français, langue officielle d’État selon le principe de personnalité, la notion de langue régionale utilisée en droit est de nature à territorialiser ce type d’expression linguistique. Les « langues et dialectes locaux » de la loi Deixonne de 1951 faisaient déjà directement allusion à ce lien territorial. La Charte européenne des langues régionales ou minoritaires, signée mais non ratifiée par la France, intègre cette dimension territoriale comme une condition première de son applicabilité. D’une part, les droits linguistiques en France sont de type « prestationnels » (droits à la différence) et impliquent en même temps des devoirs (connaître la langue française), d’autre part, ils apparaissent aussi comme des droits territoriaux. Le recours aux notions de « langue de France » et de patrimoine culturel national par le ministère de la Culture témoignent de cette préoccupation sans pour autant devoir consacrer l’émergence dans ce contexte du principe de personnalité.
