El estandar de trato justo y equitativo (TJE o FET, por sus siglas en ingles ⸻Fair and Equitable Treatment) es una de las principales garantias con que cuentan los firmantes de los tratados internacionales, para la proteccion de la inversion de sus connacionales, razon por la cual, ha sido el estandar mayormente invocado por los inversionistas extranjeros cuando pretenden hacer exigibles los derechos que han adquirido en calidad de tales ante los estados receptores de su inversion, asi como el reconocimiento de sus expectativas presuntamente vulneradas. No obstante, su efectividad depende de la aplicacion que en cada caso se haga del TJE, pues debe abordarse en conjunto con lo preceptuado por el derecho internacional consuetudinario y no solamente con aquello que expresamente se ha pactado en el instrumento internacional que lo contempla. En este punto, el reto actual, reside en la armonizacion del contenido de este estandar con la potestad regulatoria con que cuentan los estados en materia de proteccion a derechos del medioambiente, Toda vez que en multiples ocasiones las zonas con poblacion vulnerable o ecosistemas protegidos han coincidido con ser objeto de asentamiento de diversos proyectos de inversion. En este contexto, el presente trabajo pretende realizar un estudio de caso de la controversia presentada por la compania canadiense Eco Oro Minerals Corp. contra Colombia, ante el Centro Internacional de Arreglo de Diferencias Relativas a Inversiones. En efecto, se busca identificar la factibilidad del alegato de la compania con atencion a una posible violacion del estandar del TJE, consagrado en el articulo 805 del TLC Canada – Colombia, a traves de las posturas sobre la materia brindadas por la doctrina y los Tribunales arbitrales internacionales.
