La presomption absolue de prejudice du consommateur est une notion qui a connu recemment un important developpement jurisprudentiel, particulierement avec les arrets Time et Marcotte de la Cour supreme du Canada. Cependant, si ces arrets ont mis fin a plusieurs controverses doctrinales et jurisprudentielles de longue date, certaines d’entre elles n’ont pas ete tranchees et demeurent donc d’actualite. Cette presomption irrefragable, creee par l’article 272 de la Loi sur la protection du consommateur, represente un avantage de taille pour le consommateur et contribue a renforcer sa protection. Ainsi, il est interessant d’en traiter, l’equilibre entre les consommateurs et les commercants, et les moyens mis en oeuvre pour parvenir a cet ideal, constituant un theme central en droit de la consommation. Dans cet article, nous analyserons a la fois les points etablis et les points litigieux ayant trait a cette presomption, en tentant de nous servir des premiers pour eclaircir les seconds. Nous examinerons donc les conditions d’application de la presomption aux obligations des titres I et II, ainsi que l’application de la presomption aux reparations prevues a l’article 272. En outre, nous determinerons si la presomption de l’article 272 est en lien avec le dol et avec la presomption de l’article 253, et nous regarderons si les recours des articles 271 et 272 sont mutuellement exclusifs.
