Abstract
La liberté d'association protège entre autres le droit des salariés de prendre part à un processus véritable de négociation collective de bonne foi. Cela dit, il reste encore à déterminer qui sont les titulaires de ce droit constitutionnel. Ce mémoire développe la proposition selon laquelle les droits inhérents à la liberté d'association peuvent être exercés en milieu non syndiqué par des salariés regroupés en association non accréditée. L'objectif du mémoire consiste à évaluer la possibilité de reconnaître et de mettre en œuvre un syndicalisme minoritaire en complémentarité du modèle Wagner de relations du travail, en tenant compte de ses avantages allégués, mais aussi des risques que pourrait présenter l'adoption d'un modèle supplétif mettant provisoirement de côté le principe du monopole syndical de représentation. La démarche est théorique, basée sur une recherche documentaire. Les différentes sections du mémoire portent sur le modèle majoritaire-exclusif, l'impact de la jurisprudence concernant la liberté d'association, les possibilités de reconnaissance du syndicalisme minoritaire par les tribunaux, ses manifestations dans l'histoire ainsi qu'à l'étranger, les paramètres qui pourraient encadrer ce modèle sans oublier ses revers potentiels.
