Abstract
RESUME La Loi no 2 d’execution du budget de 2018 modifiee la Loi sur la faillite et l’insolvabilite et la Loi sur les arrangements avec les creanciers des compagnies afin de proteger les droits d’utilisation de propriete intellectuelle conferes a des tiers par une personne insolvable. Cet article decrit le traitement de la propriete intellectuelle lors des procedures d’insolvabilite commerciales sous deux angles : d’une part, le maintien et la resiliation des contrats relatifs a la propriete intellectuelle et, d’autre part, la vente des droits de propriete intellectuelle et la cession des contrats relatifs a ceux-ci. ABSTRACT The Budget Implementation Act, 2018, No. 2, amends the Bankruptcy and Insolvency Act and the Companies’ Creditors Ar rangement Act to protect the intellectual property rights granted by an insolvent person to third parties. This article describes the treatment of intellectual property in commercial insolvency proceedings in Canada from two perspectives: the continuation and disclaimer of intellectual property agreements, and the sale of intellectual property rights and the assignment of agreements pertaining to them.
