espanolLos contratos internacionales de transporte de pasajeros no se incluyen en el ambito de aplicacion de las normas de Derecho internacional privado protectoras de los consumidores, por lo que no le son de aplicacion los foros recogidos en el art. 17.3 del Reglamento Bruselas I-bis. El contrato de transporte internacional de pasajeros espanoles llevado a cabo por la empresa irlandesa Ryanair establece entre sus condiciones generales que los Tribunales competentes son los irlandeses. Los tribunales espanoles en la STSJ Madrid CA de 30 octubre 2013, Sentencia JM Valencia 16 febrero 2017, SAP Madrid 26 julio 2017 han tenido que pronunciarse sobre la validez de esa clausula de eleccion de tribunal. EnglishInternational contracts of transport of passengers are not included in the scope of application of the rules of private international law protecting consumers, so that the Jurisdiction over consumer contracts in art. 17.3 of the Brussels I-bis Regulation is not apply to a contract of transport. The contract of international transport of Spanish passengers carried out by the Irish company Ryanair establishes among its general conditions an agreement conferring jurisdiction to the Irish Court. The Spanish courts in the STSJ Madrid CA of October 30, 2013, Judgment JM Valencia February 16, 2017, SAP Madrid July 26, 2017 have had to pronounce on the validity of that agreement conferring jurisdiction.
