Abstract
Le cartulaire municipal de Tarascon en Provence, rédigé vers 1435-1438, de facture assez hétérogène, contient trois blocs statutaires qui sont eux-mêmes de nature très différente : les statuts édictés par la reine Jeanne de Naples en 1345 en réponse aux requêtes des ambassadeurs de la ville, reprenant un texte plus ancien qui remonte aux dernières années du xiiie siècle ; les chapitres de paix négociés avec la reine Marie de Blois au terme de la guerre de l’Union d’Aix en 1387-1390 ; et une longue série de 102 textes qualifiés de nova statuta, qui sont autant de lettres et d’actes intéressant la communauté de Tarascon depuis 1199. Ces trois blocs constituent le noyau du jus proprium de la ville. Dans l’assemblage qu’il en fait, le rédacteur du cartulaire fait œuvre de compilation plutôt que de codification d’un ensemble statutaire à proprement parler. Ceci reflète le faible degré d’autonomie du jus edicendi d’une communauté qui tend à s’approprier des normes d’origine exogène plutôt qu’à créer son droit particulier, bien que, par la forme de la requête ou de la supplique, elle joue un rôle non négligeable dans ce travail d’appropriation.
