Abstract
Dix ans après l’entrée en vigueur du Statut de Rome de la Cour pénale internationale , le droit congolais a connu des réformes intégrant dans la législation congolaise certaines dispositions pertinentes du Statut de Rome. Le principe de coopération entre la Cour pénale internationale (CPI) et la République Démocratique du Congo (RDC) a été mis en exergue et se manifeste au travers de la situation de la RDC pendante devant la CPI. Il en est de même du principe de complémentarité qui s’exerce par le biais de la répression des crimes internationaux aussi bien devant la CPI que devant les juridictions congolaises. Celles-ci ont produit une jurisprudence prolifique digne d’attention pouvant s’inscrire dans la contribution des juridictions congolaises au développement du droit international pénal et humanitaire. Notre article examine le parcours d’adaptation du droit congolais au Statut de Rome de la CPI en scrutant les forces et faiblesses.
