À partir d’observations empiriques et d’observations théoriques, l’auteure expose deux manières de construire la relation au droit, l’une empruntant à l’idée d’aliénation — le droit est vu comme un cadre strict « déjà-là » (logique de l’interprétation, du choix entre réponses existentes), l’autre se rapportant davantage à l’idée de créativité — le droit est envisagé telle une expérience à formuler dans une rencontre entre des parties et une situation (logique de l’expérimentation, de la création de réponses possibles). L’auteure explore quelques idées pouvant appuyer une éthique constructiviste du droit qui soit orientée par de nouvelles façons d’être et de faire non seulement dans la production de la normativité de type juridique, mais aussi dans la conduite de la recherche (volonté de voir, d’écouter, d’être en relation significativement, d’intégrer des points de vue différents, etc.). En considérant la recherche comme une source potentielle, toutefois non officielle, de droit, et un endroit privilégié pour générer de l’innovation sociale par le droit, l’auteure présente trois manières distinctes de faire de la recherche en droit, pratiquées par ce qu’elle appelle le juriste-cartographe (point de vue interne), le juriste-voyageur (point de vue externe) et le juriste-architecte (point de vue engagé).
