Les États parties à la Convention européenne des droits de l’homme participent parfois avec un autre État, une organisation internationale, ou un acteur non étatique, à la violation de celle-ci. Dans ce contexte, cet article se penche sur l’approche de la Cour européenne des droits de l’homme dans l’application et l’interprétation des règles pertinentes de la responsabilité des États et des organisations internationales codifiées par la Commission du droit international. Cet article examine en particulier la jurisprudence de la Cour en matière de l’attribution de la conduite et de la responsabilité à raison du fait internationalement illicite commis par un État tiers ou une organisation internationale. L’empreinte de cette jurisprudence ne se limite pas à la confirmation, parfois mécanique, des règles en question, mais assez souvent s’écarte de ces règles et contribue à leur développement. Cela nous ramène à une question complexe, qui reste toujours ouverte à l’heure actuelle, soit celle de savoir si nous sommes en l’espèce face à une interprétation du droit général de la responsabilité par la Cour, ou face à un régime spécial de la responsabilité dans le cadre de la Convention européenne des droits de l’homme, ou bien s’il s’agit plutôt d’une interprétation large, par la Cour, de certaines normes primaires consacrées en cette dernière.
