A vitimização secundária pela justiça criminal: os casos R V Wagar e Bárbara

Abstract

Discutiu-se a vitimização secundária pelo Sistema de Justiça Criminal das mulheres vítimas de crimes sexuais. Realizou-se revisão bibliográfica de análise de conteúdo, com consulta a livros-texto, trabalhos acadêmicos, artigos científicos, decisões judiciais e leis. Colheram-se aportes da criminologia brasileira e estrangeira atual. Analisaram-se as sentenças absolutórias proferidas no caso R v Wagar (Corte Provincial de Alberta), bem como no caso Bárbara (Corte Constitucional da Colômbia, Sentencia T-126/18). A partir do caso R v Wagar, depreendeu-se que ecoa mentalidade masculina tradicional e patriarcal no Sistema de Justiça Criminal, de exposição da vida pregressa, conduta moral e intimidade familiar e sexual da suposta mulher vitimizada, associada à retórica do consentimento tácito e passivo, fragilizando-se a análise do juízo de reprovação penal da conduta do alegado autor do fato e a verificação da presença de elementos probatórios a comprovarem ou a afastarem o consentimento sexual expresso da eventual vítima. Com base nas balizas da Sentencia T-126/18, constatou-se que se deve evitar juízos de valor com referência à personalidade ou ao aspecto físico da suposta vítima de violência sexual. Notouse que, ao citar as partes dos depoimentos entendidas pertinentes, deve-se fazê-lo de forma literal, mediante citações textuais e apenas quanto aos excertos com relação direta com o esclarecimento sobre a presença, ou não, dos elementos do tipo penal. Percebeu-se que a Justiça Criminal deve limitar-se a construções frasais tão só descritivas e hipotéticas, em tom objetivo e respeitoso das declarações da suposta vítima, abstendo-se, tanto quanto possível, de frases afirmativas ou categóricas.
