L’auteur soutient que l’ensemble des regles canadiennes regissant les marques de commerce sont directement transposables aux litiges impliquant des noms de domaine. L’article temoigne d’une approche comparee et passe en revue des decisions canadiennes, americaines et britanniques. Dans un premier temps, l’auteur brosse un tableau theorique du droit des marques de commerce au Canada et etudie plus precisement certaines violations reconnues dans la Loi sur les marques de commerce ainsi que dans la jurisprudence. Dans un second temps et apres avoir contextualise les notions de confusion et de «passing off», l’auteur enchaine avec une analyse comparative de l’applicabilite du droit des marques de commerce aux noms de domaine. Ce faisant, des decisions judiciaires cles en matiere de differends relatifs aux noms de domaine sont citees afin de mieux tirer certaines conclusions. De plus, des decisions emanant d’autres organismes competents, tel ICANN, sont invoquees dans l’article. Ces memes organismes font aussi l’objet d’une critique et d’une remise en question. Finalement, l’etude culmine vers l’evaluation de l’influence qu’exercera le droit americain sur la politique canadienne relative a la propriete intellectuelle, un theme recurrent tout au long de la presente contribution. De facon plus generale, le texte s’inscrit dans une mouvance visant a pallier la carence de textes francophones dans ce domaine et a rendre le droit de la propriete intellectuelle accessible aux systemes de common law francophone.
