Abstract
This article engages the contemporary transformation of international labour normativity by refocusing debates between civil/political rights and economic/social rights on a contextualized discussion on social inequalities. It traces the persistent labour market inequality experienced by one historically marginalized group, the black community in Canada, though the lens of a particularly problematic recent human rights decision. It first contends that efforts to reconceptualize labour law as fundamentally procedural in nature run the risk of undermining attempts to protect the economic and social rights of those most in need of labour law. It adds that neither are economic and social rights a panacea. Instead it suggests that notions of equality and decent work must play a guiding role in rethinking the indivisibility of rights, to ensure that labour law (national and transnational) fulfill both its protection and worker empowerment mandates.Cet article traite de la transformation contemporaine de la normativite du droit international du travail en recentrant le debat entre les droits civils et politiques, d’une part, et les droits economiques et sociaux, d’autre part, par une discussion sur les inegalites sociales. Il retrace l’inegalite persistante du marche du travail a l’egard d’un groupe historiquement marginalise, la communaute noire du Canada, et l’analyse a l’aune d’une decision recente et particulierement problematique en matiere de droits de la personne. Cet article defend l’idee suivant laquelle les efforts de reconceptualisation du droit du travail comme un droit de nature fondamentalement procedurale s’accompagnent du risque de saper les tentatives visant a proteger les droits economiques et sociaux des travailleurs qui en ont le plus besoin. Il suggere plutot d’employer les concepts phares d’egalite et de travail decent dans la reflexion sur l’indivisibilite des droits, afin d’assurer que le droit du travail (national et transnational) puisse remplir ses mandats de protection et d’outillage des travailleurs.
