L’auteur analyse dans l’article qui suit les principales questions soulevees par la reconnaissance du titre aborigene ou ancestral des peuples autochtones par le droit etatique. Il examine successivement les sources du titre aborigene, ses conditions d’existence et ses attributs en tentant d’offrir des reponses aux nombreuses questions encore irresolues. S’agissant des sources du titre, l’auteur fait ressortir l’approche stato-centrique de la jurisprudence dans la definition des droits ancestraux et avance notamment que la doctrine de continuite du droit precolonial revet un sens metaphorique plutot qu’operationnel. Quant aux conditions d’existence du titre, l’auteur conclut qu’elles restent encore suffisamment indeterminees pour creer une situation d’insecurite fonciere et permettre aux juges d’operer, sous le couvert d’une appreciation du dossier historique, des arbitrages socioeconomiques contemporains entre autochtones et non-autochtones. Finalement, l’etude des attributs du titre aborigene met en exergue l’incertitude qui perdure relativement a plusieurs enjeux fondamentaux, dont l’identite meme du detenteur du patrimoine ancestral. Cette indetermination du droit ainsi que la difficulte qu’eprouve la Cour supreme du Canada a inscrire la tenure autochtone dans la modernite fonciere laissent egalement planer le doute sur la capacite des autochtones de mettre en valeur leurs terres en fonction de leurs priorites de developpement.
