Abstract
Le devoir d’information dû au patient consacre l’importance de l’autonomie de la personne en matière de soins de santé. Si on peut se réjouir de cette consécration, la réparation de l’atteinte aux droits du patient lorsqu’il y a défaut d’information demeure pourtant très difficile au Québec. Les mécanismes de la responsabilité civile médicale actuels font en effet reposer une lourde charge sur les demandeurs. Malgré ces constats, le droit civil québécois ne s’est pas encore attardé à proposer des solutions concrètes pour pallier les difficultés soulevées par la responsabilité civile médicale pour défaut d’information. Ce texte vise ainsi à analyser les enjeux que présente le droit québécois de la responsabilité médicale quant à la réparation du défaut d’information et à discuter des solutions qui pourraient être mises en place, en s’attardant plus spécifiquement au préjudice d’impréparation.
