Abstract
Partendo dalla sentenza della Corte di Giustizia dell'Unione Europea del 13/10/2011, relativa alla causa C-83/10, che costituisce un ulteriore leading case sulla definizione di cancellazione del volo e la distinzione con il ritardo, sulla base dell'interpretazione giuridica del termine "volo", e sull'interpretazione dell'art. 12 del Reg. (CE) n. 261/2004 sul diritto dei passeggeri al rimborso supplementare, l'intento dell'articolo (che non costituisce una mera nota a sentenza) è ricostruire, con spirito critico e metodologia scientifica, il quadro normativo, giurisprudenziale e dottrinale rilevante in materia di "cancellazione del volo" e del regime di responsabilità del vettore aereo, sotto il profilo specifico del danno risarcibile e del rapporto fra la Convenzione di Montreal del 1999, per l'unificazione di alcune regole relative al trasporto aereo internazionale, ed il Reg. (CE) n. 261/2004, addivenendo ad un inquadramento originale dei diritti che il regolamento stesso riconosce al passeggero nell'ambito del rapporto giuridico con il vettore aereo operativo.
