International Law Treaty Developments Affecting the Bio-Based Economy

Abstract
English Abstract: Recent years have brought developments in international law with direct bearing on the bio-based economy. The primary development has been the entry into force of the Nagoya Protocol on Access and Benefit Sharing to the Convention on Biological Diversity. Other relevant developments have occurred at the World Intellectual Property Organisation (WIPO), the United Nations Educational, Scientific and Cultural Organisation (UNESCO) and Canada’s adoption of the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP). This article surveys the various developments, and posits that changes in Canada’s approach to genetic resources and traditional knowledge may evolve given changes in Government policy towards Indigenous Peoples. French Abstract: Les evolutions des dernieres annees en droit international ont eu une incidence directe sur la bioeconomie. La plus notable est l’entree en vigueur du Protocole de Nagoya sur l’acces aux ressources genetiques et le partage juste et equitable des avantages decoulant de leur utilisation a la Convention sur la diversite biologique, mais d’autres developpements ont notamment eu lieu du cote de l’Organisation mondiale de la propriete intellectuelle, de l’UNESCO et du Canada, qui a ratifie la Declaration des Nations Unies sur les droits des peuples autochtones. L’article survole les diverses nouveautes et suggere, a la lumiere de la nouvelle orientation politique du gouvernement a l’egard des peuples autochtones, que le Canada pourrait changer d’orientation quant a ses ressources genetiques et aux savoirs ancestraux.
