En los dias actuales, debido al avance tecnologico experimentado por la sociedad, se sabe que el uso malintencionado del entorno virtual termina transformandolo en un instrumento para la comision de delitos, como el de la violacion por internet. El articulo trata del delito de violacion virtual, estableciendo como objetivo general el analisis de este tipo delictivo en el ordenamiento juridico brasileno a traves del articulo 213 del Codigo Penal, cuyo texto fue modificado por la Ley brasilena no 12.015 de 2009, ademas del estudio de casos concretos internacionales sobre el tema de la violacion por internet, como de los Estados Unidos, de Suecia y de Canada. Para lograr este objetivo, se utilizo metodologia descriptiva cualitativa a la luz del Derecho Comparado, basada en la investigacion bibliografica, ademas de material publicado en los medios de comunicacion. Este analisis busco demostrar como la percepcion de la posibilidad de que la violacion se practique virtualmente es reciente no solo en el regimen legal brasileno, sino tambien en otros paises, evidenciando la importancia de estudiar este asunto para que exista un tratamiento legal mas uniforme de esta conducta, facilitando el marco legal del delito de violacion virtual y, ademas, ampliando el conocimiento publico sobre su existencia.
