Abstract
A presente dissertação tem como objeto de estudo o planeamento fiscal agressivo e os mecanismos adotados pelas instituições Europeias e internacionais, no combate a esse flagelo. Para melhor se compreender o fenómeno do Planeamento fiscal abusivo e elisão fiscal, nada é mais importante que entender-se o seu conceito, pelo que, começou-se a dissertação, pela clarificação de alguns conceitos relevantes para o assunto em análise, nomeadamente, a definição de comportamentos intra legem, contra legem e extra legem. É igualmente importante, verificar como a Jurisprudência do Tribunal Justiça da União Europeia (TJUE), tem definido a elisão fiscal, através da definição da expressão, «expedientes meramente artificiais» e a aplicação do principio da substância sobre a forma. Posteriormente importava conhecer os mecanismos estabelecidos pelas instituições e organismos internacionais, no qual Portugal é membro integrante, que tentam combater e limitar a elisão fiscal, para o efeito, analisou-se o projeto BEPS apresentado pela OCDE, em 2013, que vai influenciar todos os trabalhos futuros, inclusive vai originar o pacote anti abuso da União Europeia, que engloba uma Diretiva, que vai ser analisada igualmente, em todas as suas áreas. Para finalizar o enquadramento teórico, foi efetuada um resumo de cada uma das normas fiscais anti abuso, plasmadas no ordenamento jurídico fiscal Português, já atualizadas com a transposição da Diretiva anti abuso da União Europeia, bem como, da lei 26/2020, de 21 julho, que revoga o DL 29/2008 de 25 fevereiro. Seguidamente, efetuar-se-á um estudo de cinco casos práticos, sobre a aplicação das várias cláusulas especificas e geral anti abuso, por parte da AT, com quatro decisões do CAAD e um acórdão do Tribunal Central Administrativo do Sul, finalizando-se o trabalho com uma análise comparativa entre essas normas anti abuso que constam na legislação fiscal Nacional com as plasmadas no normativo jurídico de países como, a Espanha, França e Canada.
