French Abstract: Francais : Bien que le Canada soit percu comme un pays riche en eau, ce statut privilegie doit etre demystifie. Les problematiques a cet egard se multiplient : inondations printanieres dans la vallee de l’Outaouais, secheresses dans le sud des Prairies, phenomenes d’eutrophisation dans les Grands Lacs, contaminations du fleuve Saint-Laurent, qualite desastreuse de l’eau dans les reserves autochtones, etc. Les enjeux relatifs a l’eau ont des impacts de plus en plus larges. Leurs etendues geographiques s’accroissent et leurs repercussions sur l’environnement humain et non-humain s’aggravent. Il n’y a plus de doutes ; le Canada fait desormais face a une crise emergente de l’eau. D’un point de vue juridique, ces problematiques generent des defis extremement complexes. En effet, puisque chacun des ordres de gouvernements a une capacite d’agir a l’egard des questions relatives a l’eau, les mecanismes de gestion sont caracterises par une nature profondement interjuridictionnelle. Il en resulte des initiatives sectorielles, une action fragmentee et un manque important d’harmonisation entre les acteurs de l’eau. Si le droit canadien de l’eau s’est largement developpe a partir des annees soixante, les outils legislatifs, reglementaires et politiques demeurent multiples et disperses. De ce fait, le Canada n’est toujours pas equipe pour pleinement repondre aux enjeux contemporains de l’eau et aux processus de gestion qu’ils requierent. En raison de ce constat, des appels repetes en faveur d’une strategie nationale de l’eau au Canada ont ete formules par la doctrine et les experts en la matiere. Face a la necessite de tenir compte des enjeux canadiens de l’eau, notre these cherche a determiner de quelles manieres il est possible de concilier la necessaire mise en œuvre d’une strategie nationale de l’eau au Canada avec les specificites de l’environnement hydrosocial en presence. L’analyse conceptuelle de la gestion de l’eau et l’etude contextuelle de l’environnement hydrosocial canadien revelent certains obstacles a la mise en œuvre d’une strategie nationale : quelle echelle, quels agents et quelle logique de regulation devraient articuler la construction juridique d’un cadre de gestion de l’eau au Canada ? Afin de repondre a ces interrogations, nous avons elabore douze principes directeurs visant a poser les pierres fondatrices d’un regime juridique de l’eau adapte aux realites canadiennes. A l’heure ou les reflexions gouvernementales sur une future agence canadienne de l’eau sont engagees, notre these preconise un modele institutionnel pancanadien fonde sur l’echelle du bassin versant, issu de la cooperation intergouvernementale et maintenu par une collaboration entre les acteurs de l’eau representative des dynamiques territoriales. English Abstract: Although Canada is perceived as a water-rich country, this privileged status needs to be demystified. Water-related problems are indeed multiplying: spring flooding in the Ottawa Valley, droughts in the southern Prairies, eutrophication in the Great Lakes, contamination of the Saint Lawrence River, disastrous water quality on Aboriginal reserves, etc. Water issues are having increasingly broad effects. Their geographic extent is increasing and their impact on the human and non-human environment is growing. There is no longer any doubt; Canada now faces an emerging water crisis. From a legal point of view, these issues generate extremely complex challenges. Indeed, since each order of government has a capacity to act regarding water, management mechanisms are characterized by a profoundly interjurisdictional nature. This results in sectoral initiatives, fragmented action and a significant lack of harmonisation between water stakeholders. While Canadian water law has developed significantly since the 1960s, the legislative, regulatory and policy tools remain multiple and dispersed. Accordingly, Canada is still not equipped to fully respond to contemporary water issues and the management processes they require. As a result, there have been repeated calls for a national water strategy in Canada from the literature and experts in the field. Given the need to address Canadian water issues, our thesis seeks to determine how the necessary implementation of a national water strategy in Canada can be accommodated with the specificities of the hydrosocial environment. The conceptual analysis of water management and the contextual study of the Canadian hydrosocial environment reveal certain obstacles to the implementation of a national strategy: what scale, agents and regulatory logic should articulate the legal construction of a water management framework in Canada? To answer these questions, we have developed twelve guiding principles to lay the building blocks for a water legal regime adapted to Canadian realities. While government reflections on a future Canadian water agency are under way, our thesis advocates for a Canada-wide institutional model based on the watershed scale, resulting from intergovernmental cooperation and maintained through a collaboration process between water stakeholders that is representative of territorial dynamics.
