Abstract
En el presente trabajo se ha realizado un estudio de la legislacion internacional (Leyes Modelos) vigente en materia de comercio electronico y contratacion electronica asi como de la legislacion nacional y publicaciones oficiales del Ministerio de Justicia y otros organismos oficiales del Estado Cubano, con la idea de proponer una via para suplir en alguna medida la insuficiencia legislativa existente en materia de contratacion electronica y determinar su validez como modalidad contractual en el entorno juridico cubano. Se determino la validez de la contratacion electronica entre empresarios en un entorno cerrado y las vias de adecuacion de la legislacion existente a este tipo de modalidad contractual, y ademas se propuso una solucion practica realizando el diseno de un sistema de contratacion electronica nacional en entorno cerrado. Lo cual constituyo el principal aporte del autor. El principal logro de este trabajo ha sido la propuesta de El portal Cubano de Contratacion Electronica el cual es una solucion que garantizaria la integridad, autenticidad, y confidencialidad de la informacion que se intercambia entre los operadores del comercio, reduce costos operacionales, garantiza pagos online, evita cadenas de impago y soluciona conflictos online entre otras ventajas, asi como establece garantias legales para sus actores. Por tanto se convierte en una opcion unica y viable para desarrollar el comercio de bienes y servicios por via electronica e impulsar el B2B cubano.
