Sommaire Pour favoriser la concurrence entre les entreprises qui participent aux appels d’offres des organismes publics, une certaine jurisprudence reconnaît historiquement un droit égal à toutes les entreprises de conclure un contrat avec l'État : il s'agirait d’une expression du principe d'égalité devant le service public. Or, en parallèle avec les travaux de la Commission d'enquête sur l'industrie de la construction, le législateur québécois a adopté diverses normes visant à restreindre les entreprises pouvant déposer une soumission en réponse à un appel d'offres d'un organisme public ou municipal québécois. Ce principe est‐il toujours applicable au Québec, et si oui, quelle est sa portée au vu des modifications législatives récentes? Contracter avec l'État québécois est‐il toujours un droit, ou s'agit‐il maintenant plutôt d'un privilège?
