Spanish Abstract: El presente articulo pretende entregar una vision critica de los elementos procesales de la nueva Guia para el Analisis de Operaciones de Concentracion dictada por la Fiscalia Nacional Economica en octubre de 2012, junto con indicar aquellos aspectos deficitarios de nuestro actual sistema que solo pueden ser resueltos a traves de una reforma al Decreto Ley No 211. El trabajo toma como marco de referencia los sistemas comparados de Estados Unidos, Australia, el Reino Unido y la Union Europea, que fueron previamente analizados en la tesis de magister del autor. English Abstract: The present article aim to give a critical view of the procedural elements contained in the new 'Guide for Merger Analysis' issued by the Fiscalia Nacional Economica in October 2012, along with indicating the deficient aspects of our current merger control procedures that can only be solved through a reform of Decree Law 211. This document uses as its theoretical framework the merger control systems of the United States, Australia, the United Kingdom, and the European Union, which were previously analysed in the author's master degree thesis.
