Abstract
O presente trabalho tem como objetivo analisar se o porte de drogas para uso pessoal no Brasil, em especifico a Cannabis, fere o Principio da Alteridade do Direito Penal, diretamente ligado ao Direito a Liberdade, o qual afirma que a conduta, para ser criminalizada, deve ferir bem juridico alheio. Para isso, faremos breve estudo sobre o conceito do principio em questao e sobre a historia da Cannabis no Brasil, buscando entender o porque de sua criminalizacao e quais sao as consequencias para aquele que responde pelo crime de porte de maconha para uso pessoal. Tambem, observaremos a realidade atual do Brasil em relacao aos usuarios da droga, buscando entender se a criminalizacao da Cannabis realmente diminuiu seu consumo. Dando continuacao na pesquisa proposta, estudaremos a realidade internacional e consequencias da descriminalizacao da substância em alguns paises, como Portugal, Uruguai, Estados Unidos e Canada. Por fim, observaremos se os reflexos da descriminalizacao tiveram consequencias que ferem bem juridico alheio, sabendo assim se a criminalizacao deve ser mantida segundo o principio estudado.
