Access to Justice of Young People in Quebec and in Canada - General Observations and Basic Challenges (L’accès à la justice des jeunes au Québec et au Canada – grandes observations et enjeux de base)

Abstract
English Abstract: This article first shows the legal principles that define the parameters of the participation of young people in the judicial process, paying particular attention to the context of protection and placement. The authors mention, in particular, the elements of the minors' judicial hearings, and the need to define guidelines. Next, the notion of participation is discussed as understood by the Convention on the Rights of the Child and the limits of its application in Quebec. The authors also refer to the rights toolkit developed by the ABC, which is intended for legal professionals representing a young client, and which could serve as a guide for Quebec lawyers. This kit, which presents key case law and explains the fundamental principles of children's rights, could indeed represent a compass for this singular practice. Finally, the issues and challenges that deserve greater attention from the actors involved with young litigants are explained. Because, as BC Chief Justice Bauman noted, access to justice “is not about paternalism. It is about empowerment ”. French Abstract: Cet article montre d’abord les principes juridiques qui definissent les parametres de la participation des jeunes au processus judiciaire, en portant une attention particuliere au contexte de protection et de placement. Les auteurs evoquent notamment les elements de l’audition judiciaire des mineurs, et la necessite de definir des lignes directrices. Ensuite, la notion de participation est abordee telle qu’entendue par la Convention relative aux droits de l’enfant et les limites de son application au Quebec. Les auteurs evoquent aussi la « trousse d’outils sur les droits de l’enfant» developpee par l’ABC et qui se destine aux professionnels du droit mandates par un jeune client, et qui pourrait servir de guide aux juristes quebecois. Cette trousse, qui presente la jurisprudence cle et qui explique les principes fondamentaux des droits de l’enfant, pourrait en effet representer une boussole pour cette pratique singuliere. Finalement, les problematiques et les defis qui meritent une plus grande attention des acteurs impliques aupres de jeunes justiciables sont expliques. Car, comme l’a souligne le juge en chef de la Colombie- Britannique Bauman, l’acces a la justice “is not about paternalism. It is about empowerment”.
