Abstract
Parmi les différentes recommandations de la commission Pepin-Robarts, la « formule d’amendement constitutionnel » qu’elle proposait a eu peu de répercussions, probablement parce que celle-ci ne s’est pas reflétée dans la procédure mise en place lors du rapatriement de 1982 . Or, en comparant cette proposition avec les formules de Fulton-Favreau et de la Charte de Victoria, puis avec la procédure de révision adoptée lors du rapatriement et les mécanismes qui s’y sont ensuite greffés, on parvient non seulement à mieux cerner les origines et les mérites de ce que proposait la commission Pepin-Robarts en matière de révision constitutionnelle, mais également comment certains de ces mécanismes se sont finalement fait un chemin dans le paysage constitutionnel canadien. À ce titre, les veto régionaux et le référendum constitutionnel représentent quelques exemples de dispositifs faisant partie de la formule d’amendement constitutionnel de la commission Pepin-Robarts et qui trouvent aujourd’hui application lors d’une modification de la Constitution.
