« L’excès de pouvoir » du juge constitutionnel : entre dérapage et colmatage

Abstract
Le droit comme la nature a horreur du vide. La faillibilite de l’oeuvre constituante justifie souvent l’exorbitante du juge constitutionnel. Telle est l’hypothese que nous formulerons dans cet article pour repondre a la question de l’exces de pouvoir du juge constitutionnel. Nous verrons que la constitution etant « une toile inachevee », sa completude s’effectue souvent au prix d’une usurpation de la fonction constituante par le juge constitutionnel. En outre, on ne saurait nier que la continuite de l’oeuvre constituante s’impose souvent comme une necessite pour parer au deni de justice constitutionnelle, voire a l’inadequation de certaines dispositions constitutionnelles au moment critique que vivent souvent les institutions de l’Etat. Ainsi, un « delit » d’usurpation de la part du juge constitutionnel est souvent commis pour eviter un deni de justice constitutionnelle et un dysfonctionnement institutionnel. Le sursis a statuer du juge constitutionnel peut paralyser le fonctionnement des institutions. On aurait pu imaginer un tel scenario au Gabon en 2018 n’eut ete la contestable intervention du conseil constitutionnel dans le champ « competentiel » du pouvoir constituant afin d’assurer la continuite de l’exercice de la fonction presidentielle. Tout ceci, au detriment de la specialisation fonctionnelle des pouvoirs constituants et constitues. Ce faisant, le moment jurisprudentiel fusionne avec le moment constituant. Des lors, en se deplacant hors de son orbite, le juge constitutionnel transforme le moment jurisprudentiel en un moment constituant. Cette exorbitance conduit parfois a un exces de pouvoir du juge constitutionnel.
