Abstract
RESUME Cet article propose une serie de commentaires editoriaux sur cinq decisions canadiennes rendues en 2020 en matiere de propriete intellectuelle dans le monde numerique. Nous abordons divers sujets, notamment la concession de licences expresses et implicites de droits d’auteur et de marques de commerce, ainsi que l’emploi et le controle des marques de commerce, le tout a l’ere de l’Internet. Les decisions que nous presentons sont accompagnees de nos reflexions sur les changements de paradigmes juridiques majeurs que nous vivons depuis pres de 25 ans avec l’avenement d’un environnement numerique plus grand que nature. L’annee 2020 aura ete une annee charniere notamment en raison de l’impact de la COVID-19 sur l’uberisation de l’economie traditionnelle. Comment traiterons-nous les questions d’utilisation de la propriete intellectuelle dans un contexte de realite augmentee, d’intelligence artificielle, de metavers ? A suivre… ABSTRACT This article offers a series of editorial comments on five Canadian decisions rendered in 2020 relating to intellectual property in the digital world. We discuss a variety of topics, including express and implied licensing of copyrights and trademarks, as well as trademark use and control, all in the Internet age. The decisions we present are accompanied by our reflections on the major legal paradigm shifts we have been experiencing for nearly 25 years with the advent of a larger-than-life digital environment. The year 2020 will have been a pivotal year particularly because of the impact of COVID-19 on the uberization of the traditional economy. How will we deal with the issues of intellectual property use in a context of augmented reality, artificial intelligence, metaverse? To be continued…
