Abstract
Dans les systèmes américain et français, les procès en matière de terrorisme présentent de fortes différences. Il existe de nombreuses juridictions différentes et bien que la partie civile ne soit pas impliquée dans un procès pénal, elle dispose d'un recours en réparation dans les affaires civiles. Les procédures pénales fédérales sont contradictoires. Le ministère public et la défense négocient tout au long de la procédure sur les charges retenues et les peines applicables. Les procès pour terrorisme sont soumis à des lois spécifiques qui criminalisent le soutien matériel apporté au terrorisme et entraînent des peines plus sévères pour les terroristes reconnus coupables. La phase du procès visant à déterminer la culpabilité se déroule devant un jury, et les représentants des deux parties posent des questions aux témoins, le président du tribunal ne traitant que des questions de droit. Une fois reconnu coupable, un accusé comparaît lors d'une seconde audience, en vue de déterminer la peine, souvent devant un juge. Après leur condamnation, les terroristes reconnus coupables sont soumis à des mesures particulières visant à les isoler et à limiter leurs communications avec le monde extérieur.
