Abstract
I þessu verkefni er leitað svara við rannsoknarspurningunni, hver er bakgrunnur og astaeður serstakrar meðferðar a gengishagnaði og tapi i skattskilum? Byrjað er a þvi skilgreina hugtokin skattur, tekjur og gengishagnaður og greint er fra helstu lagaakvaeðum um skattlagningu sem er að finna i Stjornarskra Islands og logum um tekjuskatt. Serstaklega er kannað hvort gengishagnaður teljist tekjur samkvaemt almennri skilgreiningu um að tekjur seu eignaaukning. Gerð er grein fyrir olikum reglum sem gilda um skattalega meðferð gengishagnaðar einstaklinga og fyrirtaekja, en skattlagning gengishagnaðar einstaklinga byggir a innlausn meðan skattlagning fyrirtaekja byggir a afollnum gengishagnaði. Fyrirtaekjum ber einnig skylda til að dreifa gengistapi og gengishagnað a þrju ar. Rannsakað er hvaða astaeður liggja a bak við serreglur gagnvart fyrirtaekjum og hvort þaer seu i samraemi við almennar reglur um skattskil og reikningsskil fyrirtaekja. Islenska kronan er litill gjaldmiðill sem hefur sveiflast mikið a siðast liðnum arum, þvi er kannað hvort skattaleg meðferð gengisbreytinga hafi ahrif a hegðun fyrirtaekja i þa att að fyrirtaeki faeri eignir ur erlendri mynt i islenskar kronur eða nýti ser heimild i logum til að gera arsreikninga sina i erlendri mynt. Að lokum var rannsakað hvort skattlagning gengishagnaðar faeri gegn akvaeðum um fjorfrelsið i samningnum um Evropska efnahagssvaeðið.
