Abstract
INTRODUCTIVEpar Michèle RIVET * Il y a plus de vingt ans maintenant, le Tribunal des droits de la personne a été créé par amendements à la Charte des droits et libertés de la personne du Québec; toutes les dispositions le mettant en place sont entrées en vigueur le 10 décembre 1990.Comme l'écrit Gil Rémillard, alors Ministre de la Justice en 1990, en préface dans un livre reprenant les textes des présentations faites lors d'un colloque organisé par le Tribunal des droits de la personne en collaboration avec le Barreau du Québec, en mars 2010 :Nous avions choisi la date du 10 décembre pour souligner la relation que nous voulions établir entre la création de ce nouveau Tribunal des droits de la personne et la Déclaration universelle des droits de l'homme.Nous étions au lendemain de la chute du mur de Berlin et au début de cette démocratie émergente qui triomphait sur le communisme, donnant un nouvel espoir de liberté pour des millions d'êtres humains, mais créant aussi de nouvelles sensibilités entre les peuples qui retrouvaient leur capacité d'exprimer leur spécificité (…)[N]ous voulions donc souligner l'universalité des droits et libertés et inscrire la mission du Tribunal dans une perspective internationale.
