Abstract
La présente étude traite dans un premier temps du statut juridique du golfe du Saint-Laurent au regard du droit international. La méthode des lignes de base droites et la doctrine des eaux historiques servent de cadre théorique à la réflexion de l’auteure. Dans un deuxième temps, l’auteure analyse le statut du golfe en droit interne canadien. À cette fin, elle passe en revue la législation canadienne pertinente à cet égard. À la lumière de la jurisprudence, elle se demande ensuite s’il existe une prérogative royale de délimitation territoriale au Canada. Cette question l’amène à discuter de la valeur devant nos tribunaux d’un certificat de l’exécutif se réclamant de cette prérogative, en l’absence de législation spécifique sur le golfe. Soulignons que la structure de cette analyse fut inspirée par la décision du juge Yvon Mercier dans R. c. Paul Frank Watson.
