Abstract
L’histoire psychiatrique québécoise est marquée par une surinstitutionnalisation suivie d’une longue et chaotique désinstitutionnalisation. Les réformes de l’internement civil et administratif, datant des années 1990, visaient à protéger les droits des personnes internées en judiciarisant les processus décisionnels, en encadrant le déroulement des mesures d’internement et en limitant l’atteinte aux droits. Les personnes internées continuent ainsi d’exercer leurs droits civils, notamment celui de consentir à leurs soins. Les recherches menées sur les pratiques d’internement arrivent à deux constats. Premièrement, les violations des droits des personnes internées sont monnaie courante autant dans les milieux hospitaliers que judiciaires. Deuxièmement, le nombre d’internements civils et administratifs ne cesse d’augmenter et ils concernent le plus souvent des personnes vivant dans la pauvreté et marginalisées. Les mêmes personnes faisant l’objet de multiples procédures judiciaires, il faut conclure qu’en matière d’internement psychiatrique au Québec, la sur-institutionnalisation a fait place à une sur-judiciarisation.
