L’enjeu majeur de l’eau douce pousse les organisations internationales africaines à leur accorder une attention particulière sur le continent africain. Cela se traduit par la réception juridique de la ressource dans le cadre de coopération et/ou d’intégration en Afrique. Le présent article vise à rechercher et à apprécier les assises juridiques de l’action des organisations internationales africaines afin de répondre à la question de savoir si ces constructions juridiques permettent de faire face aux enjeux africains de la gestion de l’eau douce. La présente étude montre que la prise en compte juridique de l’eau douce au sein des organisations africaines reste globalement similaire au regard de l’approche juridique. Qu’elles soient régionales ou sous-régionales, d’intégration ou de coopération, ces organisations africaines l’appréhendent suivant une logique de fragmentation faisant obstacle à une gestion efficace. Il y a donc nécessité de rompre avec cette approche pour espérer tendre vers une gestion juridique cohérente au niveau africain. Ce renouveau escompté passera certainement par l’encadrement juridique des ressources hydriques à la lumière des objectifs fixés par l’Agenda 2063 impulsant une nouvelle dynamique de développement de l’Afrique.
