Abstract
Este artículo sistematiza los detalles históricos y jurídicos de la experiencia presentada por el lonko Juan Pichún, autoridad tradicional de la comunidad mapuche (lof) de Temulemu, enfocándose en la causa de su padre, el fallecido lonko Pascual Pichún, uno de los ocho líderes en el Caso Norín Catrimán y otros (dirigentes, miembros y activistas del pueblo indígena mapuche) vs Chile en la Corte Interamericana de Derechos Humanos. El caso fue revisado por la Corte IDH en mayo del 2013 por discriminación racial y faltas al debido proceso en la aplicación de la Ley Antiterrorista a dirigentes y autoridades ancestrales del pueblo indígena mapuche que reclamaban restituciones territoriales, siendo emblemático por exponer la criminalización de las demandas reivindicativas indígenas en Chile. El capítulo aborda los momentos procesales del caso en el Sistema Interamericano de Derechos Humanos, que concluyen con la condena desde la Corte IDH al Estado de Chile, en el año 2014, y con las respectivas medidas de reparación a los líderes indígenas. Se explora la relación histórica del pueblo mapuche con el Estado de Chile y la historia de reivindicaciones territoriales del lof Temulemu. De igual modo se revisan las consecuencias del uso de la Ley Antiterrorista en la persistente criminalización de las demandas políticas y territoriales mapuche, así como se abordan las estrategias de afrontamiento desplegadas por personas y comunidades para proteger su cultura y el territorio al que pertenecen.
