L’ordinanza in commento, emessa dalla c.d. “sezione filtro” della Suprema Corte, muove le proprie considerazioni dalla circostanza che il sistema interno delle fonti è inevitabilmente permeato dalla presenza di norme internazionali ed europee. In questo panorama si inserisce la nota Convenzione di Montreal del 1999, la quale disciplina il trasporto aereo internazionale e stabilisce particolari criteri in tema di risarcimento del danno subito dei passeggeri, anche in deroga alla disciplina interna. Detta Convenzione, infatti, utilizza i Diritti Speciali di Prelievo, variamente tradotti nelle monete correnti nei singoli stati, per quantificare la massima somma risarcibile per ogni singolo passeggero (sia per quanto riguarda il danno patrimoniale che quello non patrimoniale). I Tribuna- li di merito, i quali soggiacciono anche a detta normativa, non posso liquidare danni superiori all’importo in euro corrispondete ai DSP previsti dalla Convenzione. Inoltre, altro rilevante aspetto analizzato dall’ordinanza in commento, il trasporto deve essere considerato come unitario anche qualora sia operato da vettori diversi, quando le parti lo abbiano considerato come tale, con la conseguenza che questi saranno solidalmente responsabili nei confronti del passeggero trasportato.
