Quelques réflexions sur la constitutionnalisation du droit et le constitutionnalisme au sein de l'État par Benoît PELLETIER * L'adoption de la Loi constitutionnelle de 1982, à l'occasion du rapatriement de la Constitution canadienne, a eu pour effet d'élargir le cadre constitutionnel et d'accroître la sphère dans laquelle s'exercent les interventions des cours de justice et des autres tribunaux.Ces résultantes s'inscrivent dans le contexte de la recrudescence de la constitutionnalisation du droit au Canada et elles contribuent fortement à cette dernière.En réalité, la constitutionnalisation n'est autre que l'intégration de normes, de valeurs, de principes et d'idéaux dans le corpus constitutionnel.Elle s'appuie sur l'autorité suprême de la constitution et de l'architecture constitutionnelle dans un État donné.C'est d'ailleurs en vertu de la même autorité que l'État -quel qu'il soit -élabore la norme constitutionnelle et échafaude le droit constitutionnel, et ce, en lui donnant -ou, à tout le moins, à une bonne partie de celui-ci -une valeur supralégislative.C'est également la même autorité qui permet que soit exercé le contrôle judiciaire de la constitutionnalité.S'il est vrai que la constitution acquière de ce fait une certaine rigidité sur le plan juridique, il n'en reste pas moins que les conventions constitutionnelles viennent quelque peu assouplir la situation.Celles-ci évoluent en marge du cadre constitutionnel formel, mais elles parviennent néanmoins à détailler, à modifier, à confirmer ou à neutraliser le droit strict.Quant au constitutionnalisme, il rejoint l'idée voulant que la constitution représente la source des pouvoirs dans l'État et qu'elle existe pour assurer le bon fonctionnement de cette entité politique.La constitution étend d'ailleurs ses tentacules dans l'ensemble de l'ordonnancement juridique, qu'elle imprègne de son contenu en général et de ses valeurs en particulier.Les tribunaux, qui se veulent les gardiens de la constitution, voient alors leur rôle anobli au sein de la société.Ils participent à l'évolution du droit, tout en contournant habilement la procédure de modification constitutionnelle, et ils font souvent preuve d'une grande créativité dans l'interprétation et l'application du droit, au point d'ailleurs où certains les accusent de donner dans l'activisme judiciaire, ce qui est un brin péjoratif.D'aucuns considèrent même le constitutionnalisme comme une véritable doctrine, favorable à l'« émulsion » de la constitution non seulement dans l'ordre
