Abstract
Le désenchantement à l’endroit du modèle occidental de développement fait apparaître un autre mode de vie en société dans la région des Andes. Enraciné dans la culture ancestrale du sumak kawsay, le buen vivir (« bien-vivre », BV) postule un mode de vie en harmonie avec la nature et inclusif des savoirs autochtones. En intégrant le BV, la nouvelle Constitution Montecristi de de 2008 fait place au « néo-constitutionnalisme » équatorien, lequel équilibre les droits individuels et les droits collectifs et crée un précédent mondial reconnaissant des droits à la nature. Notre article fait un bref survol de quelques articles de la Constitution de Montecristi (2008), qui propose le passage d’un État uninational à un État plurinational et pluriculturel, reconnaît des droits à la nature et les droits culturels des peuples autochtones tout en se basant sur la conception kelsénienne du droit positif.
