El Ministerio de Hacienda y Función Pública ha publicado recientemente la Orden HFP/1030/2021 que configura y desarrolla el sistema de gestión del Plan de Recuperación, Transformación y Resiliencia, en el que el principio de no causar un perjuicio significativo al medio ambiente (conocido como «DNSH»), se establece como uno de sus criterios específicos y por lo tanto de obligatoria consideración, en la ejecución de todas las actuaciones para todo el sector público y los perceptores de fondos. La evaluación de este nuevo principio ambiental se realiza en este sistema de gestión con un «test de daños ambientales» y una lista de verificación de «análisis de riesgo sobre impactos medioambientales no deseados», que los órganos responsables y gestores deberán cumplimentar para comprobar su aplicación en los procedimientos. Sin embargo, bajo la simplicidad y sencillez de estos trámites formales destinados a facilitar la coordinación y el seguimiento, subyacen importantes implicaciones prácticas en términos de carga burocrática, complejidad técnica, disponibilidad de recursos específicos adecuados y la necesidad de generar certidumbre a los sujetos implicados. Así, advertimos que pueden surgir dificultades en el abordaje de esta tarea, sobre todo si tenemos en cuenta que se va a requerir un conocimiento técnico y especializado en materia ambiental que de momento no existe en muchas administraciones.
