L’article 37 de la DNUDPA constitue une volonté d’inscrire durablement l’obligation qu’ont les États de respecter et d’honorer les traités et autres accords conclus entre les peuples autochtones et les États dans le système de droit international contemporain. Cette obligation de respect et d’exécution ne règle cependant pas tous les enjeux en lien avec les traités et autres accords. On peut penser ici à la validité du consentement initial des parties, à la nullité d’un traité pour vice de consentement, aux questions liées à leur interprétation, de leur place dans l’ordre constitutionnel ou international, de leur rôle dans la mise en oeuvre de l’autodétermination ou encore de leurs interactions avec d’autres droits collectifs reconnus. Ainsi, nous concluons qu’un processus de règlement des conflits indépendant pourra contribuer à dénouer les impasses dans les négociations quand elles surviennent ou à soutenir la mise en oeuvre des traités.
