Adopté en 2013, le règlement de Dublin III impose aux membres de l’Union Européenne (UE) la règle générale selon laquelle le pays responsable de traiter une demande d’asile est le pays par lequel le demandeur est entré dans l’UE. Ce règlement a fait face à une forte critique, notamment en ce qui concerne la protection qu’il offre aux demandeurs d’asile mineurs. Il appert que celui-ci ne permet pas aux pays d’entrée de leur offrir une protection adéquate. La forte concentration des demandes d’asile que crée le règlement de Dublin III nuit de façon exacerbée aux mineurs demandeurs d’asile en raison de leur vulnérabilité particulière. En effet, cette vulnérabilité requiert une mobilisation de ressources supérieure à celle qui est requise pour les adultes. Cela rend difficile, voir impossible, l’évaluation et le respect de l’intérêt supérieur des demandeurs d’asile mineurs. Le présent texte examine cette dynamique dans le cadre du droit à la liberté et du droit à la protection de la vie familiale, tels que protégés par la Convention européenne des droits de l’Homme (CEDH).
