Abstract
O acesso aos serviços de saúde por pessoas privadas de liberdade é realizado por meio da garantia estatal. Buscando otimizar esse acesso, criou-se a Política Nacional de Atenção Integral à Saúde das Pessoas Privadas de Liberdade no Sistema Prisional. Mesmo após nove anos da instituição da Política observa-se condições insalubres nos sistemas prisionais. Assim, essa pesquisa objetiva analisar a legislação brasileira acerca da temática da oferta à atenção integral de saúde disponibilizada aos detentos. Observa-se um caminho longo percorrido até materializar essa Política no Sistema Prisional, cercada por tratados internacionais, primando os direitos humanos e outros documentos sancionados desde 1948, difundiram a essência internacional dos direitos humanos. A Lei de Execução Penal garante que todas as pessoas privadas de liberdade têm direito ao acesso integral à saúde, garantido pelo Estado. Estas garantias e direitos estão preconizadas também pela Constituição Federal de 1988. Contudo, se trata de tema recorrente em diversos debates sobre direitos fundamentais, pois é um ambiente complexo. Com o estudo da legislação, observando a evolução das políticas públicas dedicadas aos presidiários, foi possível analisar o desenvolvimento da legislação em favor desses sujeitos na busca de promoção dos direitos garantidos tanto nos acordos internacionais quanto na legislação brasileira, e a ocorrência de fatores como a não obrigatoriedade de instituição e efetivação das políticas públicas impedem que os direitos dos detentos sejam cumpridos integralmente, como estabelecidos na legislação.
