DANS LES CAUSES DE MALFAÇONJusqu'à ce jour, l'assureur de responsabilité n'avait aucune obligation d'assumer la défense de son assuré dans les causes de malfaçon.Un arrêt récent de la Cour suprême du Canada dans l'affaire Progressive Homes Ltd. c. Cie Canadienne d'assurances générales Lombard (2010 CSC 33) change la donne.Les conclusions du tribunal s'appuient sur plusieurs facteurs : une simple possibilité de couverture suffit pour déclencher l'obligation de défendre, l'interprétation des contrats d'assurance doit être faite globalement, en prenant en compte les garanties, les exclusions et les exceptions aux exclusions.Le tribunal a également rejeté trois arguments allégués par l'assureur.Il semble que, dans cette affaire, les travaux exécutés par des sous-traitants ont suffi à enclencher l'obligation de défendre.Sur ce point, le tribunal a raison car il s'agit d'une exception à une exclusion de malfaçon formulée dans la plupart des contrats d'assurance.Là où le bât blesse est l'interprétation de la notion d'accident.Jusqu'à présent, il était clair que les conséquences de travaux mal faits ne pouvaient être considérées comme un accident, car la malfaçon ne comporte par l'aspect fortuit essentiel pour déclencher l'obligation de défendre.Or, la Cour suprême semble remettre en cause cette notion.À la lumière de cet arrêt, les assureurs doivent être prudents sur le plan de la rédaction des exclusions liées aux travaux de l'assuré.
