Abstract
The USMCA entered into force on 1 July 2020, replacing the 1994 North American Free Trade Agreement (NAFTA). The USMCA continues with a similar state-to-state dispute settlement mechanism as under NAFTA. New provisions prevent panel blocking by ensuring the formation of a dispute settlement panel; whereas, in investor-state dispute settlement (ISDS), which allow private investors to pursue claims against sovereign nations, the USMCA has limited the scope in comparison to NAFTA. Canada has opted out of the investor–state dispute resolution under the USMCA. The ISDS provision continues to apply for Mexico in government contracts in the oil, natural gas, power generation, infrastructure, and telecommunications sectors and in other sectors. Further, investor claims are limited to expropriation and non-discrimination and not for violating fair and equitable treatment. In addition, claimants must first exhaust national remedies before bringing the disputes to the international level. The USMCA, however, allows claims to continue to be brought under Chapter 11 of NAFTA concerning ‘legacy investments’ for a period of three years after the coming into force of the USMCA—that is, between 1 July 2020 and 1 July 2023 (Annex 14-C, Article 3).
