La jurisprudence est au coeur du droit constitutionnel au Canada. Une bonne compréhension du droit constitutionnel canadien requiert effectivement un examen préalable de la jurisprudence pertinente. Or, une portion importante de la jurisprudence constitutionnelle, surtout lorsqu’elle émane de la Cour suprême du Canada, prend la forme d’« avis consultatifs » ou de « renvois », formulés à la demande du pouvoir exécutif. Dans le présent article, l’auteur s’intéresse à la façon dont certains de ces renvois de la Cour suprême ont eu pour effet de redéfinir les règles du jeu constitutionnel et les rapports de force entre le Québec et le reste du Canada. À la manière d’un récit que l’on raconte, il examine les contextes politiques propres à ces renvois, leurs principales conclusions et leurs conséquences les plus importantes. Outre qu’il revient sur l’histoire constitutionnelle que façonnent ces renvois, l’auteur tente également de tirer certaines conclusions concernant les éléments qui influencent la Cour suprême dans ce type de décision, notamment le rejet de l’unilatéralisme et le recours à des sources ou à des principes non écrits.
