L’arrêt de la Cour africaine des droits de l’homme et des peuples rendu le 1er décembre 2022 dans l’affaire Tike Mwambipile et Equality Now contre République-unie de Tanzanie illustre la problématique de l’articulation entre les instruments juridiques internationaux des droits de l’homme et celle de la coexistence de leurs organes de protection. Il soulève en particulier le problème de la compétence concurrente en ce qui concerne les allégations de violations des droits de l’homme couvertes à la fois par la Charte africaine des droits de l’homme et des peuples et par la Charte africaine des droits et du bien-être de l’enfant. L’interprétation que la Cour africaine fait de la règle non bis in idem contenue dans l’article 56(7) de la Charte africaine des droits de l’homme et des peuples élargit considérablement la portée de l’interdiction de la duplication de procédure. Elle lui permet d’éviter d’exercer une compétence concurrente avec d’autres juridictions et quasi-juridictions internationales des droits de l’homme, en l’occurrence le Comité africain d’experts des droits et du bien-être de l’enfant.
