Abstract
Dans les systèmes de common law, il est largement admis que des dommages-intérêts punitifs peuvent être accordés pour sanctionner une conduite malveillante, opprimante ou abusive. L’attribution de ces dommages vise à punir l’auteur de cette conduite, à dissuader les tiers d’agir de la même façon et à marquer la désapprobation du tribunal. La situation est quelque peu différente en droit québécois où le régime des dommages exemplaires conserve un caractère d’exception. Certes, depuis quelques années, l’évolution législative et jurisprudentielle laisse entrevoir la possibilité d’une percée plus importante des dommages punitifs en droit québécois. La reconnaissance du caractère autonome du recours en dommages punitifs de l’article 49 de la Charte québécoise par la Cour suprême du Canada dans l’arrêt de Montigny confirme d’ailleurs cette tendance. Dans son texte, l’auteure démontre toutefois que l’arrêt de Montigny est loin d’avoir mis un terme aux difficultés relatives à la mise en œuvre de ce recours en droit québécois.
