Abstract
Depuis 2007, le gouvernement fédéral manifeste l’intention d’augmenter le nombre de sièges à la Chambre des communes afin de donner satisfaction aux provinces à croissance démographique rapide, soit l’Alberta, la Colombie-Britannique et l’Ontario. Cependant, le Parlement fédéral n’aurait pas le pouvoir d’instaurer une véritable « représentation en fonction de la population ». L’alinéa 42(1)a) de la Loi constitutionnelle de 1982 enchâsserait plutôt une « représentation proportionnelle modifiée » visant à protéger les petites provinces et les provinces dont la population relative décline. C’est ce qui ressort de la décision rendue en 1988 par la Cour d’appel de la Colombie-Britannique dans l’affaire Campbell. Les provinces qui bénéficient d’une protection en vertu du système actuel n’ont pas intérêt à voir leur représentation diluée dans une Chambre des communes trop élargie. Et le projet du gouvernement Harper donnerait au Québec un nombre de députés proportionnellement inférieur au pourcentage de sa population dans le Canada.
